To the People of the State of New York:

AFTER an unequivocal experience of the inefficiency of the subsisting federal government, you are called upon to deliberate on a new Constitution for the United States of America. The subject speaks its own importance; comprehending in its consequences nothing less than the existence of the UNION, the safety and welfare of the parts of which it is composed, the fate of an empire in many respects the most interesting in the world. It has been frequently remarked that it seems to have been reserved to the people of this country, by their conduct and example, to decide the important question, whether societies of men are really capable or not of establishing good government from reflection and choice, or whether they are forever destined to depend for their political constitutions on accident and force. If there be any truth in the remark, the crisis at which we are arrived may with propriety be regarded as the era in which that decision is to be made; and a wrong election of the part we shall act may, in this view, deserve to be considered as the general misfortune of mankind.
This idea will add the inducements of philanthropy to those of patriotism, to heighten the solicitude which all considerate and good men must feel for the event. Happy will it be if our choice should be directed by a judicious estimate of our true interests, unperplexed and unbiased by considerations not connected with the public good. But this is a thing more ardently to be wished than seriously to be expected. The plan offered to our deliberations affects too many particular interests, innovates upon too many local institutions, not to involve in its discussion a variety of objects foreign to its merits, and of views, passions and prejudices little favorable to the discovery of truth.
Among the most formidable of the obstacles which the new Constitution will have to encounter may readily be distinguished the obvious interest of a certain class of men in every State to resist all changes which may hazard a diminution of the power, emolument, and consequence of the offices they hold under the State establishments; and the perverted ambition of another class of men, who will either hope to aggrandize themselves by the confusions of their country, or will flatter themselves with fairer prospects of elevation from the subdivision of the empire into several partial confederacies than from its union under one government.
It is not, however, my design to dwell upon observations of this nature. I am well aware that it would be disingenuous to resolve indiscriminately the opposition of any set of men (merely because their situations might subject them to suspicion) into interested or ambitious views. Candor will oblige us to admit that even such men may be actuated by upright intentions; and it cannot be doubted that much of the opposition which has made its appearance, or may hereafter make its appearance, will spring from sources, blameless at least, if not respectable--the honest errors of minds led astray by preconceived jealousies and fears. So numerous indeed and so powerful are the causes which serve to give a false bias to the judgment, that we, upon many occasions, see wise and good men on the wrong as well as on the right side of questions of the first magnitude to society. This circumstance, if duly attended to, would furnish a lesson of moderation to those who are ever so much persuaded of their being in the right in any controversy. And a further reason for caution, in this respect, might be drawn from the reflection that we are not always sure that those who advocate the truth are influenced by purer principles than their antagonists. Ambition, avarice, personal animosity, party opposition, and many other motives not more laudable than these, are apt to operate as well upon those who support as those who oppose the right side of a question. Were there not even these inducements to moderation, nothing could be more ill-judged than that intolerant spirit which has, at all times, characterized political parties. For in politics, as in religion, it is equally absurd to aim at making proselytes by fire and sword. Heresies in either can rarely be cured by persecution.
And yet, however just these sentiments will be allowed to be, we have already sufficient indications that it will happen in this as in all former cases of great national discussion. A torrent of angry and malignant passions will be let loose. To judge from the conduct of the opposite parties, we shall be led to conclude that they will mutually hope to evince the justness of their opinions, and to increase the number of their converts by the loudness of their declamations and the bitterness of their invectives. An enlightened zeal for the energy and efficiency of government will be stigmatized as the offspring of a temper fond of despotic power and hostile to the principles of liberty. An over-scrupulous jealousy of danger to the rights of the people, which is more commonly the fault of the head than of the heart, will be represented as mere pretense and artifice, the stale bait for popularity at the expense of the public good. It will be forgotten, on the one hand, that jealousy is the usual concomitant of love, and that the noble enthusiasm of liberty is apt to be infected with a spirit of narrow and illiberal distrust. On the other hand, it will be equally forgotten that the vigor of government is essential to the security of liberty; that, in the contemplation of a sound and well-informed judgment, their interest can never be separated; and that a dangerous ambition more often lurks behind the specious mask of zeal for the rights of the people than under the forbidden appearance of zeal for the firmness and efficiency of government. History will teach us that the former has been found a much more certain road to the introduction of despotism than the latter, and that of those men who have overturned the liberties of republics, the greatest number have begun their career by paying an obsequious court to the people; commencing demagogues, and ending tyrants.
In the course of the preceding observations, I have had an eye, my fellow-citizens, to putting you upon your guard against all attempts, from whatever quarter, to influence your decision in a matter of the utmost moment to your welfare, by any impressions other than those which may result from the evidence of truth. You will, no doubt, at the same time, have collected from the general scope of them, that they proceed from a source not unfriendly to the new Constitution. Yes, my countrymen, I own to you that, after having given it an attentive consideration, I am clearly of opinion it is your interest to adopt it. I am convinced that this is the safest course for your liberty, your dignity, and your happiness. I affect not reserves which I do not feel. I will not amuse you with an appearance of deliberation when I have decided. I frankly acknowledge to you my convictions, and I will freely lay before you the reasons on which they are founded. The consciousness of good intentions disdains ambiguity. I shall not, however, multiply professions on this head. My motives must remain in the depository of my own breast. My arguments will be open to all, and may be judged of by all. They shall at least be offered in a spirit which will not disgrace the cause of truth.
I propose, in a series of papers, to discuss the following interesting particulars:
  • THE UTILITY OF THE UNION TO YOUR POLITICAL PROSPERITY
  • THE INSUFFICIENCY OF THE PRESENT CONFEDERATION TO PRESERVE THAT UNION 
  • THE NECESSITY OF A GOVERNMENT AT LEAST EQUALLY ENERGETIC WITH THE ONE PROPOSED, TO THE ATTAINMENT OF THIS OBJECT 
  • THE CONFORMITY OF THE PROPOSED CONSTITUTION TO THE TRUE PRINCIPLES OF REPUBLICAN GOVERNMENT 
  • ITS ANALOGY TO YOUR OWN STATE CONSTITUTION 
  • and lastly, THE ADDITIONAL SECURITY WHICH ITS ADOPTION WILL AFFORD TO THE PRESERVATION OF THAT SPECIES OF GOVERNMENT, TO LIBERTY, AND TO PROPERTY.
In the progress of this discussion I shall endeavor to give a satisfactory answer to all the objections which shall have made their appearance, that may seem to have any claim to your attention.
It may perhaps be thought superfluous to offer arguments to prove the utility of the UNION, a point, no doubt, deeply engraved on the hearts of the great body of the people in every State, and one, which it may be imagined, has no adversaries. But the fact is, that we already hear it whispered in the private circles of those who oppose the new Constitution, that the thirteen States are of too great extent for any general system, and that we must of necessity resort to separate confederacies of distinct portions of the whole. This doctrine will, in all probability, be gradually propagated, till it has votaries enough to countenance an open avowal of it. For nothing can be more evident, to those who are able to take an enlarged view of the subject, than the alternative of an adoption of the new Constitution or a dismemberment of the Union. It will therefore be of use to begin by examining the advantages of that Union, the certain evils, and the probable dangers, to which every State will be exposed from its dissolution. This shall accordingly constitute the subject of my next address.

Job Fair Poorly Attended in Franklin;
Congressman Heath Shuler Wonders Why

There was recently a Jobs Fair held in Franklin, NC that was poorly attended despite a high unemployment rate. I've heard that Congressman Shuler wonders why so few attended. I went to the Unemployment Office today to see how many people were there. The above photo shows a full parking lot. I sat across the road for an hour and a half this morning, and traffic was brisk, and the parking lot stayed nearly full the entire time as people cycled through, looking for work.


My answer to the Congressman is that perhaps very few even knew it was being held. I certainly didn't know about it until after the fact. Perhaps the next time you attempt something like this, a little advertising before hand would be wise. Perhaps in the Help Wanted in the classifieds or putting a notice up at the Unemployment Office.

Allegedly, there is 1 abductor: Lonnie Cecil Buchanan, JR. Lonnie Cecil Buchanan, JR is described as 41 years old, Black, male, 5 feet 8 inches tall, weighing 200 pounds. He has black hair and brown eyes. Mr Buchanan was last seen wearing blue jeans or khaki pants, no shirt. Mr Buchanan's hair is in dreads

Tropical Update for July 26th


So far, things look pretty calm in the Atlantic Basin and people are still making noise about the potential for a tropical cyclone near Puerto Rico. I don't think it will do anything other than make a lot of rain.

That's all I have for today. It looks like the next little bit should be okay...but don't take that for granted. Make it a habit to at least daily check out the tropical weather conditions. Sometimes, things change quicker than expected.


The time to prepare for Tropical Storms is before they hit. Well before they hit, not just in the week before one comes ashore. A good place to get started on preparing for a storm is the National Hurricane Center's Preparedness Page.


Even people in my area of the Appalachian Mountains should make preparations for disaster, most specifically for flooding or landslides.

Discarded Cicada Skin

Discarded Cicada Skin, Brood XIX (13 year) noted in Macon County, North Carolina on the morning of 7-24-2010






The above photo is of a discarded Cicada skin I noticed on the railing of my stairs this Saturday morning.


It's that time of year, or if you're a Brood XIX Cicada, that time of your 13 year life cycle when you must crawl out of the ground, molt, eat, sing, mate, lay eggs, then die. Only this one didn't hit the snooze button and wait until 2011, when the rest of his/her brood will be emerging. 


I did a little research via the Internet, and have surmised that it may belong to a brood of Cicadas known as 'The Great Southern Brood' that last emerged in 1998 and will be back in 2024. This is the only brood that has a known emergence in Macon County within five years of 2011. It is a straggler because it has emerged a year early. (Stragglers can emerge two years either side of the main brood).

Brood XIX is the largest (by geographical extent) brood of 13-year cicadas. This brood is also notable for including the species M. neotredecim and exhibiting a striking pattern of reproductive character displacement between M. neotredecim and M. tredecim (Cooley et al. 2001; Marshall and Cooley 2000; Simon et al. 2000).

After years of living in underground tunnels, where they feed on the juices of roots,  thousands of periodical cicadas emerge from the earth, as if by a predetermined signal, shed their nymphal skins, and spread out through the nearby trees and bushes. 

The cicada's precise but prolonged time schedule has perhaps evolved as a method of survival for the masses. When a large population of juicy insects appears on the scene, predators make the most of the situation, but simply cannot eat all the insects. Thus, a significant number of cicadas live to reproduce.The periodical cicada is able to outlast and escape most of its enemies.


Any cicadas that merge near my house may have a rough go of it this year...due to the family of squirrels I have living in my Chinese Necklace Poplar tree. (A type of tree I do not recommend growing within 45 feet of your house or underground pipes...but that is a story for another day).

I haven't heard of other reports of emerging cicadas locally.

Teachable Moment: John Kerry Slips Yacht in Low Tax Haven
Lesson for Progressives: High Taxes Chases Money Away

John Kerry's yacht, Isabel, a prima facie example of money goes where it is wanted, and flees where it is punished

The object lesson here is that higher state taxes forces people to move and hold assets and businesses out of state, even out of the country.

Sen. John Kerry, who has repeatedly voted to raise taxes while in Congress, dodged a whopping six-figure state tax bill on his new multimillion-dollar yacht by mooring her in Newport, R.I.


Isabel - Kerry’s luxe, 76-foot New Zealand-built Friendship sloop with an Edwardian-style, glossy varnished teak interior, two VIP main cabins and a pilothouse fitted with a wet bar and cold wine storage - was designed by Rhode Island boat designer Ted Fontaine.


But instead of berthing the vessel in Nantucket, where the senator summers with the missus, Teresa Heinz, Isabel’s hailing port is listed as “Newport” on her stern.




Could the reason be that the Ocean State repealed its Boat Sales and Use Tax back in 1993, making the tiny state to the south a haven - like the Cayman Islands, Bermuda and Nassau - for tax-skirting luxury yacht owners?


Cash-strapped Massachusetts still collects a 6.25 percent sales tax and an annual excise tax on yachts. Sources say Isabel sold for something in the neighborhood of $7 million, meaning Kerry saved approximately $437,500 in sales tax and an annual excise tax of about $70,000.

I also note that the Kerrys use a holding company, Great Point LLC of Pittsburgh, to hold ownership of the 75 ft long yacht. That allows them to save paying even more in taxes to the Massachusetts State Treasury. He also avoided the higher taxes on the construction of his yacht by having it built overseas in New Zealand. It is funny that his votes to raise taxes on the rich have hurt and mostly destroyed the luxury yacht-building industry in the United States, and have sent American jobs, and the money of rich Americans (like John Kerry) overseas.


I suppose this makes US Senator John Kerry a hypocrite, one of those people who tells us to do as he says, not as he does. His berthing of the $7 million-dollar yacht in a low-tax state not only saves him money, but hurts the people who work in Massachusetts. The only people who suffer are the working people and small business owners in the shipyards and ports of Massachusetts. They suffer from the ruinously high tax-rate that forces even billionaires like the Kerrys to place assets in a low tax haven like Rhode Island. The workers, and the treasury, of Rhode Island certainly benefits from having lower taxes, now don't they?


I love the hypocrisy of the left!!! They claim to be for 'the little man', but I can't tell. All I see is that they are chasing money from their states and the country with their insane tax policies.

Tractor Trailer Fire on Cowee Mountain

Tractor-trailer fire on US441N in Macon County



Here is photo of a tractor-trailer fire on US Highway 441 North in Macon County near the bottom of Cowee Mountain just above the runaway truck ramp. Franklin Fire-Rescue and Mountain Valley Fire-Rescue responded to the scene along with numerous Sheriff's Deputies and the NC State Highway Patrol to control traffic.


The Google Map shows the location. It appears that no one was hurt. WLOS-TV was already on the scene when I drove by, so they must have been in town for a story.

More questions on the origins of Facebook


Facebook is Evil

I'm posting this mainly because Facebook seems to have blocked attempts for me to post a link to an article that might be construed as detrimental to Mark Zuckerberg on Facebook, so I'm using my blog post as a manual re-direct to get around the Facebook block. Here is a portion of the article:


The case is the latest challenge to the origins of Facebook, which is worth $24.6 billion, according to SharesPost.com, a marketplace for closely held firms. Facebook’s paternity was questioned in a suit by a group of Zuckerberg’s former Harvard University schoolmates, who claimed he used code developed on their ConnectU project to start Facebook. They settled in 2008.


Today’s hearing was for Arcara to consider a request by Facebook to dissolve a temporary injunction, issued by a state court judge June 30, preventing the company from transferring assets. The parties resolved the issue by agreeing to let the injunction expire July 23. Arcara extended an order staying the injunction until then, which means it will have no effect.


The parties, appearing before Arcara for the first time in the case, also provided new details of their clients’ stories in response to questions from the judge.


“Mr. Zuckerberg did have a contract with Mr. Ceglia,” Simpson said. Zuckerberg, 26, worked for Ceglia as a computer coder, she said.


Facebook claims Ceglia remained silent for more than six years and his claim is probably too old to pursue. Also, Ceglia claims his alleged contract, which refers to “The Face Book,” was signed about nine months before Facebook was founded, the company said in court papers.


Today in court, Ceglia’s attorney, Terrence Connors, produced a copy of the two-page “work for hire” contract that his client said entitles him to control of the social-networking service.

And They Call Tea Partiers Violent?

In Raleigh, North Carolina, about a 1,000 Lefties gathered to protest a busing system change the Wake County School Board has enacted that they claim would result in schools being resegregated by organizing schools by neighborhood instead of by race. 19 of them, including the head of the North Carolina NAACP were arrested. Most of the arrests occurred when a group violently disrupted the meeting by gathering around the podium, chanting and singing.


Why is it when Lefties gather to protest, there are almost invariably some of them who commit acts of violent disruption and are arrested?


There have been thousands upon thousands of tea parties across the nation over the past two years, and very few people have been arrested. In fact, when arrests occur it is almost always because of Lefty counter-protesters.


Here are the names of those arrested and the charges against them [source for list], note that a good number of them are not even residents, nor (upon further investigation by yours truly) registered voters of Wake County.

Chinedu Collins Ifejika, of 200-202 Tobler Court in Durham, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Michelle Laws, of 3715 Shrewsburt St. in Durham, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Jimmie Ray Hawkins, of 4415 Sun Valley Dr. in Durham, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Erin Dalebyrd, of 605 East South St. in Raleigh, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Marie Alisa Garlock, of 610-325 West Morgan St. in Durham, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Bobby Gray Jones, 308 East Chestnut St. in Goldsboro, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Laurel Anne Ashton, of 505-C North Greesnboro Road in Carrboro, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Anthony Jerome Davis, 6617 Barton Creek Drive in Whitsett, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Madeline Clair Miller, of 231 Hillcrest Circle in Chapel Hill, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.

Camellia Lee, of 205 Black Tie Lane in Chapel Hill, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Curtis Gatewood, of 413 Kingsbury St. in Oxford, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Samuel Scott Bass, of 2720 Poole Road in Raleigh, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Keith Ausustus Rivers, of 104 Granview Drive in Elizabeth City, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.


Robert Thompson Stephens, of 525 Hedgewood Place in Winston-Salem, was arrested and charged with second-degree trespassing and disorderly conduct in connection with a demonstration at the Wake County schools administration building in Raleigh on Tuesday, July 20, 2010.

Trespassing and Disorderly Conduct? Do they sound like peaceful protesters? They sound like people who are willing to commit violence, and break the law, in order to get their way...instead of relying on the tried and true method of acting at the ballot box. 


Here is a challenge for you Lefties out there, find me documentation of a tea party that has disrupted a government meeting, seized control of the podium, and resisted arrest. You can't, because the tea parties are peaceful affairs focused on enacting change via the ballot box. 


The Left seems not to have faith in free and fair elections...and put more stock in violent disruptions and protests. It is a good thing that the Wake County School Board has not bowed to the terroristic acts of the NAACP.

Tropical Update for July 20, 2010



So far, things look pretty calm in the Atlantic Basin and people are still making noise about the potential for a tropical cyclone near Puerto Rico. I don't think it will do anything other than make a lot of rain.

The time to prepare for Tropical Storms is before they hit. Well before they hit, not just in the week before one comes ashore. A good place to get started on preparing for a storm is the National Hurricane Center's Preparedness Page.


Even people in my area of the Appalachian Mountains should make preparations for disaster, most specifically for flooding or landslides.

This is the full video of the Macon County Commissioners meeting that took place on Monday, July 12, 2010.


Commissioner Jim Davis spoke about the destruction of his barn by fire caused by oil soaked rags left in a bucket. He praised the volunteer firefighters of the several volunteer fire departments, the EMTs of the Macon County EMS and the officers of the Franklin Police Department that responded to the fire for their professionalism.


Public Comment


18 year employee of Macon County, Sandy Preston, addressed the Commissioners regarding her layoff as a result of budget cuts. She indicated that her husband is 100% disabled and that without her paycheck, she is concerned about losing her home and her car and she cannot afford the COBRA payments to keep her health insurance. 


Tom Ritter made a proposal about having a weekend camping event for veterans and their families in the Macon County Veterans Memorial Park.


Reports/Presentations


Commissioner Bobby Kuppers gave a report on the problem of finding a place for the teenagers of Nantahala community to swim in since they have been chased off Queens Lake by the Fish and Wildlife Service. He said that he had spent the day in Nantahala investigating the situation and potential solutions, the best of which was to find out what it will take to allow the teenagers to return to Queens Lake.


Old Business


County Manager Jack Horton presented a report on the Whitley Products lease in the Business Incubator Building in the Industrial Park. He recommended that the lease be renewed.


Commissioner Bob Siimpson reported on the Holly Springs Community Building and noted that their proposed building restoration project would have to stay within certain guidelines to preserve their ability to have the building placed on the historical register and county funding options and grant applications were also discussed. The property was deeded by Macon County to the Holly Springs Community Development Club in the 1950's. 


New Business


A property line adjustment at the existing Iotla School to allow for a safer entrance was discussed. A property line survey revealed that there had been some property line encroachment by a neighbor of the school who had built a shed that was over the boundary between the two properties. County Attorney Chester Jones described the best options for the county to relieve the situation and certain legal requirements that must be observed in the property transfer.  There was also discussion of the Cullasaja School property being declared surplus. 


The Consent Agenda


During this portion of the meeting, all items are voted upon in one motion and included approving the following items, the minutes of the June 28th Meeting of the Commissioners, several budget revisions were made, and the cancellation of the July 26, 2010 meeting was discussed. (The commissioners have wanting to go back to just one meeting a month instead of the two meetings a month schedule they have observed since 2008). Chairman Ronnie Beale was designated the voting delegate to the North Carolina Association of County Commissioners (NCACC) Annual Conference in Pitt County on August 26-29, 2010. 


The entire consent agenda was passed unanimously. 


Appointments


A new nonprofit corporation is being formed to receive ownership of the Orchard View Housing complex and Macon County has been allocated a position on the oversight board. Stan Jeffries was recommended and approved for the position. The term will expire on July 1, 2013. 


Closed Session


The commissioners then went into a closed session for the purposes of preserving attorney/client privilege. There were no announcements after the session.
