Town of Franklin Declares a Fire Danger Emergency

PRESS RELEASE (11-30-2021)

TOWN OF FRANKLIN


DECLARATION OF A FIRE DANGER EMERGENCY


WHEREAS, weather or other conditions exist which may make the open buming of any substance unduly hazardous and a danger to public safety, and in conjunction with the North Carolina Forest Service's bum ban which was instituted on November 29,2021 at 5:00 p.m. the Mayor has declared a "Fire Danger Emergency"; and


WHEREAS, as a result of the above-described emergency I have determined that there is an imminent threat of, or existing conditions may cause or could cause, widespread or severe damage, injury, or loss of life or property; and


WIIEREAS, declaring a Fire Danger Emergency and imposing the restrictions and prohibitions ordered herein is necessary to maintain order and protect public health, safety, and welfare, and to secure property.


NOW, THEREFORE, pursuant to the authority vested in me as the Mayor of the Town of Franklin under Article A of Chapter 166-4 of the North Carolina General Statutes and Chapter 34 of the Town of Franklin Code oF ordinances:


Section 1. A Fire Danger Emergency is hereby declared within the jurisdiction of Franklin.


Section 2. The emergency area covered by this state of emergency shall be the town limits of the Town ol Franklin and its extraterritorial jurisdiction.


Section 3. The following restrictions and prohibitions are imposed 


a. All open buming of any substance shall be prohibited within any or all of the Town of Franktin until such time as the bum ban declaration from the North Carolina Forest Service has been rescinded; and


b. Open buming means the intentional buming ol any substance, whether natural or manmade, or the intentional casting offofany burning substance, whether natural or manmade, except the buming of such substance in a container sufficient so as to prohibit the escape of any of the buming substance, or any sparks, flames or hot ashes from the container; and


c. The escape of any of such burning substance, or the escape of any sparks, flames or hot ashes from any such container shall be deemed prima facie evidence that the container was insuffrcient so as to meet the exception from the definition of an open buming set forth herein.


d. The maintaining of a fire in any interior fireplace, stove or fumace is specifically excluded from the definition of an open buming as contemplated by this declaration. 


Section 4. I hereby order all Town of Franklin law enforcement officers, employees, and all other emergency management personnel subject to our control to cooperate in the enforcement and implementation of the provisions of this Declaration, all applicable local ordinances, state and federal laws, and the Town of Franklin Emergency Operations Plan.


Section 6. This declaration shall take effect on November 30 at 9:00 a.m., and shall remain in effect until modified or rescinded.

Burn ban issued for all North Carolina counties due to hazardous forest fire conditions



 



RALEIGH - Due to increased fire risk, the N.C. Forest Service has issued a ban on all open burning and has canceled all burning permits statewide effective at 5 p.m. today until further notice.

“It is fall wildfire season in North Carolina, and we are seeing wildfire activity increase due to dry conditions,” said Agriculture Commissioner Steve Troxler. “With these ongoing conditions, a statewide burn ban is necessary to reduce the risk of fires starting and spreading quickly. Our top priority is always to protect lives, property and forestland across the state.”

Under North Carolina law, the ban prohibits all open burning in the affected counties, regardless of whether a permit was previously issued. The issuance of any new permits has also been suspended until the ban is lifted. Anyone violating the burn ban faces a $100 fine plus $183 court costs. Any person responsible for setting a fire may be liable for any expenses related to extinguishing the fire.

Local fire departments and law enforcement officers are assisting the N.C. Forest Service in enforcing the burn ban.

The N.C. Forest Service will continue to monitor conditions. Residents with questions regarding a specific county can contact their N.C. Forest Service county ranger or their county fire marshal’s office.

Answers to FAQ



Q: What is open burning?

A: Open burning includes burning leaves, branches or other plant material. In all cases, burning trash, lumber, tires, newspapers, plastics or other nonvegetative material is illegal.

Q: May I still use my grill or barbecue?

A: Yes, if no other local ordinances prohibit their use.

Q: How should I report a wildfire?

A: Call 911 to report a wildfire.

Q: How should I report a person who intentionally starts a wildfire?

A: Call 911 to report a wildfire.

Q: My local fire marshal has also issued a burn ban for my county. What does this mean?

A: The burn ban issued by the N.C. Forest service does not apply to a fire within 100 feet of an occupied dwelling. Local government agencies have jurisdiction over open burning within 100 feet of an occupied dwelling. The N.C. Forest Service has advised county fire marshals of the burning ban and has asked for their consideration of also implementing a burning ban. If a fire within a 100-foot area of a dwelling escapes containment, a North Carolina forest ranger may take reasonable steps to extinguish or control it. The person responsible for setting the fire may be liable for any expenses related to extinguishing the fire.

Q: Are there other instances which impact open burning?

A: Local ordinances and air quality regulations may impact open burning. For instance, outdoor burning is prohibited in areas covered by Code Orange or Code Red air quality forecasts. Q: Can I have a campfire when I go camping?

A: Campfires would be considered open burning and are not exempt from the burn ban. During a burn ban, portable gas stoves or grills are alternate methods for cooking food while camping.

Our local weather pattern this week will be dominated by a high pressure system. Potentially active weather will not return until Saturday night, when slightly better moisture ahead of a cold front may allow for light rain and snow across the mountains.

...ELEVATED FIRE DANGER TODAY...

Dry conditions will continue and lead to an increased risk of dangerous fire growth Monday. Relative humidity values will fall between 20 and 25 percent across much of western North Carolina. The dry air, combined with low fuel moisture, will allow fires to develop easily and spread more quickly than usual. Outdoor burning is discouraged.
