Democrats Take Aim At Weapons Ban


I'm starting off my coverage of this event with a commentary.


COMMENTARY

The Democrats are taking aim at another weapons ban, this time under the auspices of US Senator Dianne Feinstein's Assault Weapons Ban of 2013. This is a bill that proposes to ban weapons and to force the registration of previously purchased weapons that meet the criteria for being banned and illegally forces these legal owners to undergo a background check. This, in my opinion, violates the ex post facto provisions in the US Constitution. [link] But, I don't expect Democrats to be people who would respect any provision of our constitution if it stands in the way of something they want.

The introduction of this bill should be the clarion call to awaken a movement so large that it will dwarf the Tea Party of 2009. What I think this new movement should do is to work tirelessly to oppose these members of Congress and to contribute to their defeat when they next come up for election. We should work to ensure that it would be political suicide for anyone to introduce a similar bill for the next generation.

Sen. Dianne Feinstein (D-Calif.) and a group of Senate Democrats on Thursday introduced legislation to ban the sale and manufacture of more than 150 types of semi-automatic weapons with military-style features.

The legislation also bans magazines holding more than 10 rounds of ammunition and requires people who already own assault rifles to use secure storage and safety devices and bars them from selling high-capacity clips.

“No weapon is taken from anyone,” said Feinstein. “The purpose is to dry up the supply of these weapons over time.”
Unlike the 1994 assault-weapons ban, there is no sunset provision in Feinstein’s newest gun-control bill.

Here is a bill summary and a list of the weapons that would be banned under the bill:

Assault Weapons Ban of 2013

Mass shootings in Newtown, Aurora, and Tucson have demonstrated all too clearly the need to regulate military-style assault weapons and high capacity ammunition magazines. These weapons allow a gunman to fire a large number of rounds quickly and without having to reload.

What the bill does:

The legislation bans the saletransfermanufacturing and importation of:
  • All semiautomatic rifles that can accept a detachable magazine and have at least one military feature: pistol grip; forward grip; folding, telescoping, or detachable stock; grenade launcher or rocket launcher; barrel shroud; or threaded barrel.
  • All semiautomatic pistols that can accept a detachable magazine and have at least one military feature: threaded barrel; second pistol grip; barrel shroud; capacity to accept a detachable magazine at some location outside of the pistol grip; or semiautomatic version of an automatic firearm.
  • All semiautomatic rifles and handguns that have a fixed magazine with the capacity to accept more than 10 rounds.
  • All semiautomatic shotguns that have a folding, telescoping, or detachable stock; pistol grip; fixed magazine with the capacity to accept more than 5 rounds; ability to accept a detachable magazine; forward grip; grenade launcher or rocket launcher; or shotgun with a revolving cylinder.
  • All ammunition feeding devices (magazines, strips, and drums) capable of accepting more than 10 rounds.
  • 157 specifically-named firearms (listed at the end of this page).
The legislation excludes the following weapons from the bill:
  • Any weapon that is lawfully possessed at the date of the bill’s enactment;
  • Any firearm manually operated by a bolt, pump, lever or slide action;
  • Assault weapons used by military, law enforcement, and retired law enforcement; and
  • Antique weapons.
The legislation protects hunting and sporting firearms:
  • The bill excludes 2,258 legitimate hunting and sporting rifles and shotguns by specific make and model.
The legislation strengthens the 1994 Assault Weapons Ban and state bans by:
  • Moving from a 2-characteristic test to a 1-characteristic test.
    • The bill also makes the ban harder to evade by eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test.
  • Banning dangerous aftermarket modifications and workarounds.
    • Bump or slide fire stocks, which are modified stocks that enable semi-automatic weapons to fire at rates similar to fully automatic machine guns.
    • So-called “bullet buttons” that allow the rapid replacement of ammunition magazines, frequently used as a workaround to prohibitions on detachable magazines.
    • Thumbhole stocks, a type of stock that was created as a workaround to avoid prohibitions on pistol grips.
  • Adding a ban on the importation of assault weapons and large-capacity magazines.
  • Eliminating the 10-year sunset that allowed the original federal ban to expire.
The legislation addresses the millions of assault weapons and large-capacity magazines currently in existence by:
  • Requiring a background check on all sales or transfers of a grandfathered assault weapon.
    • This background check can be run through the FBI or, if a state chooses, initiated with a state agency, as with the existing background check system.
  • Prohibiting the sale or transfer of large-capacity ammunition feeding devices lawfully possessed on the date of enactment of the bill.
  • Allowing states and localities to use federal Byrne JAG grant funds to conduct a voluntary buy-back program for grandfathered assault weapons and large-capacity ammunition feeding devices.
  • Imposing a safe storage requirement for grandfathered firearms, to keep them away from prohibited persons.
  • Requiring that assault weapons and large-capacity ammunition feeding devices manufactured after the date of the bill’s enactment be engraved with the serial number and date of manufacture of the weapon

Assault weapon bans have been proven to be effective

The 1994 Assault Weapons Ban was effective at reducing crime and getting these military-style weapons off our streets. Since the ban expired, more than 350 people have been killed and more than 450 injured by these weapons.
  • A Justice Department study of the assault weapons ban found that it was responsible for a 6.7% decrease in total gun murders, holding all other factors equal.

  • The same study also found that “Assault weapons are disproportionately involved in murders with multiple victims, multiple wounds per victim, and police officers as victims.”
  • The use of assault weapons in crime declined by more than two-thirds by about nine years after 1994 Assault Weapons Ban took effect.

  • The percentage of firearms seized by police in Virginia that had high-capacity magazines dropped significantly during the ban. That figure has doubled since the ban expired.
  • When Maryland imposed a more stringent ban on assault pistols and high-capacity magazines in 1994, it led to a 55% drop in assault pistols recovered by the Baltimore Police Department.

Macon County Commissioners 01-08-2013

The Macon County Commissioners met Tuesday night for the first regular meeting of the year. I have embedded videos of the meeting below. About 20 minutes into the first video is the portion of the meeting where Macon County Sheriff Robbie Holland ran a scenario involving a shooter at a school for the Commissioners to establish why he is against arming school teachers.

Chicago City Council Passes New Handgun Restrictions Only 4 Days After Previous Restrictions Struck Down By Supreme Court

Barely four days after the Supreme Court affirmed the right of Chicagoans to keep and bear arms in defense of their families and property, the city council of Chicago has passed a new draconian set of Daley handgun restrictions. Perhaps I should add Mayor Daley and the 45 members of the Chicago City Council to the Gun Control Advocates Hall of Fame pictured above.


Mayor Daley had been prepared to have his unconstitutional restrictions overturned, according to this article in the Chicago Tribune.

Four days after the U.S. Supreme Court gutted Chicago’s longtime handgun ban, the City Council on Friday enacted a whole new set of gun-control measures.


Alderman voted 45-0 in favor even as some of them acknowledged how little the restrictions would do to quell violent crime.


The rush job is aimed at having a new set of established handgun restrictions in place before a lower court enters a final order to formally strike down the city’s gun ban.


The ordinance “places reasonable regulations regarding who should and should not be able to possess a handgun in their home for self-defense,” Mayor Richard Daley said after the special council meeting. “With this law, we're supporting adults who legitimately want a gun in their home for self-defense. But at the same time, we're trying to keep guns out of the hands of gang bangers and drug dealers who only want to terrorize our communities.”


Several aldermen, however, said the ordinance is more likely to affect responsible, law-abiding gun owners than the thugs causing mayhem on hot weekend nights.


“You cannot legislate criminals, they are going to be criminals no matter what,” said Ald. Ed Smith, 28th. “And the people who intend to do crime, they are going to do it in whatever manner they can. They are going to get a gun wherever they can. And they are going to use it. And they are not going to register their gun.”


After making a similar acknowledgement, Ald. Deborah Graham, 29th, issued a plea. “I also would encourage gang bangers who get those guns unlawfully to stop getting them unlawfully,” she said. “We’re going to increase the penalties to make sure our communities are safe.”


When the new law takes effect in 10 days, people who want to keep a handgun in their homes and be on the right side of the law will have to obtain Chicago firearm permits. To get one, they must take firearms training and not have convictions for a violent crime, unlawful use of a firearm or two or more charges of driving under the influence of drugs or alcohol.


Each weapon would have to be registered, and those with permits will only be able to register one weapon each month.
Guns could only be kept in the home, and each per permit holder in the home could only have one handgun in readily operable condition at a time.

Supreme Court Affirms Second Amendment

The scary part is that it was a 5-4 decision. Our Republic, and Constitution, hang by a thread.

Two years ago, in District of Columbia v. Heller, this Court held that the Second Amendment protects the right to keep and bear arms for the purpose of self-defense and struck down a Dis-trict of Columbia law that banned the possession of handguns in thehome. Chicago (hereinafter City) and the village of Oak Park, a Chi-cago suburb, have laws effectively banning handgun possession byalmost all private citizens. After Heller, petitioners filed this federalsuit against the City, which was consolidated with two related ac-tions, alleging that the City’s handgun ban has left them vulnerable to criminals. They sought a declaration that the ban and several re-lated City ordinances violate the Second and Fourteenth Amend-ments. The Seventh Circuit affirmed, relying on three 19th-century cases—United States v. Cruikshank, 92 U. S. 542, Presser v. Illinois, 116 U. S. 252, and Miller v. Texas, 153 U. S. 535— which were decided in the wake of this Court’s interpretation of theFourteenth Amendment’s Privileges or Immunities Clause in the Slaughter-House Cases, 16 Wall. 36.


Held: The judgment is reversed, and the case is remanded.

The Virginia Tech Massacre




Three years ago today, a criminal (who shall not be named here) with a weapon roamed free in a gun free zone, able to pick off targets at will.


The shooter, a student, shot 49 people on the Virginia Tech campus that day. 32 people died, and 17 were wounded, but survived. A further 6 were wounded while escaping (jumping out of windows, off stairways, etc) from the kill zone.


There were many acts of heroism that day. Here are some of them:


Liviu Librescu, a 76 year old survivor of the Nazi death camps held his classroom door shut and purchased the time needed for his students to flee with his life.


Ryan C. Clark, a 22 year old senior, was shot and killed while trying to aid a fellow student.


Instructor Jocelyne Couture-Nowak and student Henry Lee were killed as they attempted to barricade the door to their classroom.


Students Katelyn Carney and Derek O'Dell were injured while holding the door closed to their classroom.


It is believed that student Partahi Mamora Halomoan Lumbantoruan may have protected fellow student Guillermo Colman by diving on top of him, and protecting him with his body. Partahi was killed after being shot multiple times.


Professor Kevin Granata brought 20 students from a nearby classroom into an office, where the door could be locked, on the third floor of Norris Hall. He was killed by the shooter while investigating the situation and looking for more students.


The shooter killed 5 faculty members and 27 students, and wounded 17 others three years ago today on the gun free campus of Virginia Tech before committing suicide.


One instructor, faculty member, grounds person or student with a firearm could have saved some of those lives. It is my belief that the people in charge of Virginia Tech were criminally, and personally, liable for every one of those deaths and injuries. Some of the victim's families have won some relief from the Commonwealth of Virginia.




I have always carried on college campuses I've attended, visited or driven through, and I am sure others do as well. One of these days, a shooter will have his killing spree cut short by an armed person who is exercising his/her constitutional rights, which exceed whatever local laws or ordinances have been enacted. I know that if I sat on a jury where charges were being brought against someone who defended them self (and others) with a weapon illegally carried...I would not vote to convict. Download the handy information there and learn it well enough to be able to share it with your fellow jurors should the need ever arise.


The photo above and to the right is a reproduction of a sticker I always affix to signs placed at businesses and government buildings telling people that weapons aren't allowed on the premises, just to let people know that their Second Amendment Right has been suspended in the area, and that the owners of the business are now liable if you are killed or injured on their property.

Celebrating the Second Amendment:
Introducing the KRISS Vector CRB/SO™.45 ACP

I'm dedicating this post to Jessica B (a sometime commenter here) and all those other Lefties who are afraid of people who are practicing their Second Amendment Rights by owning (and using) firearms.


A new submachine has been making the rounds over the past couple of years that uses a .45 ACP round (SQUEE!!!) and is named after an Indonesian sword called the Kris.


My favorite version of the KRISS is the one with the much shorter barrel, as pictured at the top of this post. It is a submachine gun that is available in a .45 ACP version. That's right, kids...why play with mere 9mm or .308 SMGs when a grown up .45 ACP is available? Especially one that doesn't kick like a mule.


The KRISS employs a revolutionary design in submachine gun design, the impact of the recoil is directed downward and counteracts the muzzle climb tendency of the weapon. From the KRISS-TDI website:


All traditional firearms share a common problem; they utilize heavy linear operating mechanisms that deliver recoil forces directly into the operator's shoulder. California Moves to Limit Ammunition Sales

I found this disturbing news on the Old Glory Radio website:

AB962, sponsored by Assembly Member Kevin De Leon (D-45), is in the Assembly Committee on Appropriations. AB962 would make it a crime to privately transfer more than 50 rounds of ammunition per month, even between family and friends, unless you are registered as a “handgun ammunition vendor” in the Department of Justice’s database. Ammunition retailers would have to be licensed and store ammunition in such a manner that it would be inaccessible to purchasers. The bill would also require purchasers submit to fingerprinting, which would be submitted to the Department of Justice. Lastly, mail order ammunition sales would be prohibited.

Commentary

It seems to me that lefties know they can't succeed in taking our weapons from us...so they are trying to start an end run around that by limiting ammo sales for handguns.

After all, there is nothing so fearsome to the statists as the thought of private citizens exchanging ammo, or even stockpiling it against the day when we are forced to defend ourselves from government tyranny...and hit the reset button on our form of government.

This bill would make it a crime to give more than 50 rounds of handgun ammo as a gift to a friend or family member...

Personally, I view this legislation (and any like it) as a violation of the Second Amendment of the U.S. Constitution, and void. Were I living in California, I would be a criminal from the day this bill was passed into law.

College Student Kills Home Invader, Saves Many Lives

[Note--My views on this subject are very radical. I believe that the US Constitution is the highest law of the land and supercede any other law.]



A group of college students said they are lucky to be alive and they’re thanking the quick-thinking of one of their own. Police said a fellow student shot and killed one of two masked me who burst into an apartment.

Channel 2 Action News reporter Tom Jones met with one of the students to talk about the incident.

“Apparently, his intent was to rape and murder us all,” said student Charles Bailey.

Bailey said he thought it was the end of his life and the lives of the 10 people inside his apartment for a birthday party after two masked men with guns burst in through a patio door.

“They just came in and separated the men from the women and said, ‘Give me your wallets and cell phones,’” said George Williams of the College Park Police Department.

Bailey said the gunmen started counting bullets. “The other guy asked how many (bullets) he had. He said he had enough,” said Bailey.

Commentary

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

If these students had been on campus, the student who saved his life, and that of the other college sudents, would be facing unconstitutional criminal charges.

Note to all you lefties and college administrators (but I repeat myself), one of these days, a criminal is going to pick the wrong place on a college campus to use a gun in the commission of a crime and there will be someone with a firearm present.

I pray that that person's aim is true and they kill the criminal. I also pray that the college community and the other members of the militia (all citizens) rise up to defend their brother or sister from an unconstitutional criminal charge.

There are far more weapons being carried on college campuses by students, faculty and staff than you realize. Those weapons are for self-defense and consitutionally carried every day without incident.

Speaking for myself (and myself only) I recognize no law that is unconstitutional in nature. Imagine the security of a nation where tens of millions of college students provided for their own defense. Indeed, that should be so on every square inch of American soil.

Like Admiral Yamamoto is reputed to have said,

"I would never invade the United States. There would be a gun behind every blade of grass."

We need to make sure that criminals (and those whom we elect to public office) would have that very same fear of the American people.
